Terms of Service

1. Purpose
These Terms of Service (TOS) govern the use of the Hire Spark platform, a recruitment management software (ATS - Applicant Tracking System) accessible in SaaS mode (Software as a Service).
The use of the Platform implies unreserved acceptance of these TOS.
2. Definitions
- Plateforme : the Hire Spark service accessible at hirespark.io
- Utilisateur : any individual using the Platform (recruiter, manager)
- Client : the company that has subscribed to the Platform
- Candidat : any person applying for a job through the Platform
- Compte : a User's personal space on the Platform
3. Access to the Platform
3.1 Registration
Access to the Platform requires the creation of an Account. The User agrees to provide accurate information and to maintain the confidentiality of their login credentials.
3.2 Age Requirements
The use of the Platform is reserved for adults acting in a professional capacity.
3.3 Availability
We strive to keep the Platform accessible 24/7. However, access may be interrupted for maintenance, updates, or in case of force majeure.
4. Services Offered
The Platform offers the following features:
- Publication and management of job offers
- Reception and processing of applications
- Automatic CV analysis using artificial intelligence
- Visual recruitment pipeline (Kanban)
- Interview scheduling
- Communication with candidates
- Application tracking page with AI chatbot
- Recruitment statistics and analytics
- Collaborative multi-user management
Available features depend on the subscription plan.
5. Subscriptions and Pricing
5.1 Available Plans
- Demo : Free for 14 days, limited features
- Pro : €199/month, for SMEs and scale-ups
- Enterprise : €499/month, unlimited features
5.2 Billing
Subscriptions are billed monthly or annually as chosen by the Client. Annual payment benefits from 2 free months.
5.3 Trial Period
Every new Client benefits from a free 14-day trial with access to Demo plan features. No payment method is required for the trial.
5.4 Cancellation
The Client may cancel their subscription at any time. Cancellation takes effect at the end of the current billing period. No refund is made for the remaining period.
6. User Obligations
The User agrees to:
- Use the Platform in accordance with its purpose and applicable laws
- Not publish illegal, discriminatory, or misleading content
- Respect candidates' rights, particularly regarding personal data
- Not attempt to compromise the security or operation of the Platform
- Not use unauthorized robots or automated scripts
- Immediately report any suspected unauthorized access to the Account
7. Hire Spark Obligations
Hire Spark commits to:
- Provide a service consistent with its description
- Ensure the security and confidentiality of data
- Maintain Platform availability within reasonable limits
- Provide technical support according to the subscribed plan
- Notify Clients of any substantial modification to services
8. Intellectual Property
8.1 Hire Spark Property
The Platform, its source code, interface, trademarks, and logos are the exclusive property of Hire Spark. Any unauthorized reproduction, modification, or use is prohibited.
8.2 User Content
The Client retains ownership of the data and content they publish on the Platform. They grant Hire Spark a limited license to process this data as part of service delivery.
9. Data Protection
The processing of personal data is governed by our Privacy Policy.
The Client, as data controller for candidate data, agrees to comply with GDPR and to inform candidates about the use of their data.
10. Limitation of Liability
Hire Spark cannot be held liable for:
- Indirect damages, loss of profits or data
- Use made by Users of the Platform
- Content published by Users
- Service interruptions due to external events
In any case, Hire Spark's liability is limited to the amounts paid by the Client during the last 12 months.
11. Modification of TOS
Hire Spark reserves the right to modify these TOS. Users will be informed of any substantial modification by email or notification on the Platform. Continued use of the Platform constitutes acceptance of the new TOS.
12. Applicable Law and Jurisdiction
These TOS are governed by French law. Any dispute relating to their interpretation or execution will be submitted to the competent courts of Paris, unless otherwise provided by law.
